TERMS & CONDITIONS FOR competitions promoted by Spot The Shot are open to all persons aged over 18 except anyone prohibited by law (either English law or an entrant’s own national law) from entering into a competition of the type offered by Spot The Shot. Please read these terms carefully before using the Website. Using the Website indicates that you accept these terms regardless of whether or not you choose to register with us. If you do not accept our Terms and conditions do not use www.spottheshot.com.
These Terms and Conditions of Use are issued by Spot The Shot Limited, a company incorporated in England and Wales (company number 07248898) with its registered office at Woodlands, Amerston, Wynyard, Cleveland. TS22 5QX. To contact Spot The Shot please see the ‘Contact Us’ of the Website. Changes in these Terms and Conditions. – Spot The Shot LTD reserve the right from time to time to change its Terms and Conditions, Privacy Policy or any other legal aspect of its competitions, website or its basis of trading with its customers. Certain provisions of these Terms of Use may be superseded by expressly designated legal notices or terms located on particular pages at the Website.
1 Introduction
1.1 Spot The Shot employees, members of their immediate family, or any other person who is connected with the creation, judging, monitoring or administration of the competition are not eligible to enter.
1.2 By entering a competition, the entrant will be deemed to have read and understood the rules and to be bound by them and by any other requirements set out in any related promotional material. There may be additional rules or legal requirements for specific competitions, so please read and understand the specific terms and conditions for each individual prize which are displayed on the same page of the prize to which they apply. The entrant will be bound by both the specific terms and conditions and these rules which apply to all competition prizes.
1.3 The competitions are governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. In the event of playing this competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. The Promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt, you should immediately leave the website, not enter the competition, and check with the relevant authorities in your own country.
1.5 Spot The Shot is intended for use by users located within the United Kingdom (England, Scotland, Northern Ireland and Wales). If you access www.spottheshot.com and use any other part of the Website from outside of the United Kingdom you are solely responsible for making sure that such use and access is legal in the territory in which you are located.
2 License
2.1 Copyright and other intellectual property rights in all material on the Website (including without limitation photographs and graphical images) are owned by Spot The Shot or its licensors.
4 Playing Instructions.
4.1 Using the information shown in the photograph displayed on the computer screen (from which the original ball has been permanently erased), use your skill and judgment to correctly identify the pixel which you consider the judge will decide is the most likely position of the centre of the ball. Click on the screen to mark this spot (you can see your spot’s coordinates on the screen). The computer will register this spot as your entry into the competition.
4.2 When you are ready to purchase your selection(s) follow the on-screen instructions to provide your contact details and then your credit/debit card details. When your card payment is cleared, we will then contact you by e-mail to confirm your entry into the competition.
4.3 When entering a competition online, you will not be deemed entered the competition until we confirm your ticket details back to you by e-mail.
4.4 You must retain this e-mail as confirmation of your entry and to validate your entry and be eligible to win the prize.
4.5 If you play the ‘FREE GAME’ this is used to test you skill and deter some people from playing and in no way guarantees that you will win the real/Money competitions if you get a high score.
5 Determination of the winner.
5.1 The competition may finish either on a date advertised or after the sale of a pre-determined number of pixels or a combination of both.
5.2 For each individual competition, the centre of the ball position will be determined by an independent judge (usually an independent sporting expert appointed by the Spot The Shot), using his experience and in the presence of a lawyer and a representative from the Spot The Shot. The judge's chosen position will then be computed against the database of coordinates of all entries to calculate which of the competitors is closest to the judge’s position, and therefore the winner of the prize.
5.3 The winner will be the person who correctly identifies the pixel which the centre of the ball is judged to be located. Some of our competitions will award prize money to the nearest pixel to the judged location and this will be indicated on the Terms for the respective competition.
5.4 In the event of a tie, the joint winners will share the prize. All decisions of the judge will be final and binding on the competitors and no correspondence will be entered into.
6 Notification and identification of the winner.
6.1 The winner of each competition will be notified at the verified email address details within 14 days of the closing date of the relevant competition.
6.2 Any entrant may check the results of competitions completed within the last 6 months on our website www.spottheshot.com.
6.3 Some winners will be required to send a copy of their passport or other identification to the Spot the Shot to confirm their identity, age and also to prove that, if the purchase was made by credit/debit card, the card was legally theirs or they had authorisation to use it, before any prize will be paid or delivered. Following receipt and verification of the details above by the Promoter, the winner will be contacted in order to make arrangements of the prize. In the event that the winner does not send the requested documents to the Promoter and/or the winner’s details cannot be verified, after 10 days from and including the date the winner was identified, the original winner will be deemed replaced by the person judged to have submitted the second best entry. If the second winner cannot be identified within 10 days from the date the second winner was identified then he/she will be replaced by the third best entry, and so on until we can verify the identity of a winner.
6.4 The winner may also be asked to provide photographs for use in future marketing by the Promoter.
7 Rights of Spot the Shot.
7.1 We reserve the right to cancel any competition, for any reason, before the designated closing date. In these circumstances, the Promoter reserves the right to transfer the customer’s ticket into another competition for which the ticket price is at least the same or more than the original price paid.
7.2 The Promoter also reserves the right, at its sole discretion, to extend the closing date on any time-limited competition even if that competition is also subject to a pre-determined number of qualifying ticket sales.
7.3 While Spot The Shot endeavours to ensure that the Website is normally available 24 hours a day, Spot The Shot shall not be liable if for any reason the Website is unavailable at any time or for any period.
7.4 Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Spot The Shot's control.
7.5 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.
8 Exclusion of liability of the Promoter.
8.1 Spot the Shot makes no representations or warranties as to the quality/suitability/value of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Spot the Shot.
8.2 Spot the Shot shall not be liable for any loss suffered or sustained to persons or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Spot the Shot, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize-winner and, where applicable, to any family/persons accompanying the winner, or in connection with any of the competitions promoted by the Spot the Shot.
9 Data Protection Notice.
9.1 All entrants to any of our competitions are automatically entered onto a database for the purpose of conveying information as to the status of the competition entered, as well as for any future promotions, competitions or deals offered by the company. Data that we retain includes personal data. All data that we hold is subject to our Privacy Policy.
9.2 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party (for example, a credit card company) will be used by the Promoter to administer the competition, and (unless you tell us that you prefer not to receive direct marketing) to contact you about other competitions or about other goods and services which the Promoter considers may be of interest to you.
9.3 In order to process, record and use your personal data, the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; (iii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iv) any person to whom the Promoter proposes to transfer its business or any part of it; (v) comply with any legal or regulatory requirement of the Promoter in any country; and (vi) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
10 Gaming prohibitions.
10.1 Spot The Shot competitions are conducted under English law as a skill-based game and not as a lottery or a raffle. It is your responsibility to observe the national laws of your own country regarding possible gaming or gambling prohibitions and to make sure that you are allowed to enter the various competitions.
10.2 Online gaming is only permitted for adults. We believe in responsible online gaming and entertainment. For most people, gaming or gambling is entertainment.
